What are the practical implications of that? I understand that they don't have access to the Silmarillion.
Yes, they (and all the others who have any kind of 'Tolkien' license) only have access to LotR and the Hobbit. From what I know, Christopher Tolkien is not involved in any way with them and I don't know if he even gets money from their deals.

J. R. R. Tolkien sold the movie & merchandising rights to The Lord of the Rings and The Hobbit while he was yet alive. I believe he used the phrase "Art or Cash; I choose cash", or something along those lines as he had some back taxes and/or other debts to pay at the time. The rights have since passed to many owners and holders over the years; the last I checked, a company that was controlled by Saul Zaentz, Middle-earth Enterprises (Formally Tolkein Enterprises) controlled the rights, with the movie rights having been portioned off and sold separately a fair number of years before. These rights do not include The Silmarillion, published posthumously by the author's son Christopher a few years after Tolkein's death. Those rights remain in the possession of the Tolkien Estate, controlled by Christopher, and they are very unwilling to license any rights out from what I hear.
