Regarding Periapts of Wisdom, Headbands of Intellect, and Cloaks of Charisma

This is a simple enough question, that I just can't seem to find the answer to, in regards to 3.5:
Do the aforementioned magic items (Periapts of Wisdom, Headbands of Intellect, and Cloaks of Charisma) raise your ability scores in such a manner that they allow you to gain bonus spells and let you cast higher level spells?

I do know that if they do allow this to occur, and said object is removed, you would lose them (them being the bonus spells/higher level spells), but I just want to make sure that you can get those bonus spells and cast those higher level spells because of the appropriate ability score enhancing magic item.

Yes.

I am not sure how quickly they are granted though, you probably need to rest for 8 hours before getting the slots. But you will get the bonus slot.
 

And I'm not sure what the official rule is, but as far as removing them is concerned...assuming this happens after the rest & prepare spells part of the day, as DM in such a case I would say that the caster loses access to the bonus spells / higher level spells. As soon as he gets the item back, he'd regain access to the spells. I'd rule that way because a temporary increase to the casting stat wouldn't alter his prepared spells for the day, so why should a temporary decrease?

Because loss of capacity means whatever is being stored is lost as well. Fixing up the storage device doesn't get back what was stored.
 

thank you, this is more-or-less what I thought, but I wanted to be sure (since I was building a battle cleric, whose Strength was actually greater than his Wisdom, and I still wanted to make sure I can get some of the higher level spells)

As for losing them, I'll just leave that up to the DM I suppose

When you suffer con damage, you lose the appropriate amount of hp from your current and max hp totals. When the con damage is restored...you get the hp back, not just the capacity.

Ahh, but are they the same hit points?! That's the kicker. I could easily rule that they are new ones, not the ones you had previously. ;)

AFAIAC the magic item is granting a temporary bonus to begin with. When the item is lost, so is the temporary bonus. Regaining the item requires wearing it during the next 8 hour resting period.

Yes, you can get extra bonus spells if you have an item that increases the ability score that governs your spellcasting. To get the extra bonus spells, you must wear the item while resting to regain spells and all through your initial daily preparations for spellcasting. (Even characters who don’t prepare spells need to meditate a little while at the beginning of the day; see Daily Readying of spells under the Sorcerers and bards section of Chapter 10 in the Player’s Handbook.)

If you lose the item, you immediately lose the bonus spell slots the item gave you, starting with any uncast spells you have of the appropriate levels.

2) The FAQ says you immediately lose the bonus spells if the item is lost. I'm not disputing that. The FAQ quoted says nothing of what happens if the item is regained a short while later. I think there's lots of precedent in the rules of lost capacity =/= "haha, sucks to be you" when you regain it.

Maybe, but in lieu of other resources. . . . it is still the best source to have.

It says you lose the "slots" - which means the capacity and thus what was also stroed there.

It also says that in order to gain the benefit you must sleep and prepare with the item on.

So, since the slot ahs vanished then you must go through the process again in order to gain the slot back.
