A party of 5 heroes dispatches with an unholy abomination of Orcus.

Concerened that more way lay in wait, the cleric and rogue sneak off, leaving the rest to tend to wounds.

After 8 minutes the rogue returns saying that he was ambushed and the cleric felled...

Question: Do the three heroes that waited while the R+C scouted count as being between encounters? or is encounter determined at the party level?

A short rest takes 5 minutes, so if they were taking a rest during that 8 minute gap, then all the things that go along with a short rest (encounter powers recharging, etc.) would apply.

So encounter timing is based on indivuduals, not the party?

So some can rest while others do somrthing that violates the 5 minute rule and don't get to spend healing surges, regain encounter abilities...etc?

Yup. To rest or not is an individual choice.
