Stone Golem and Stone Shape

Ok from Stone Golem:

Immunity to Magic (Ex): A stone golem is immune to any spell or spell-like ability that allows spell resistance. In addition, certain spells and effects function differently against the creature, as noted below.

Ok now Stone Shape:

Transmutation [Earth]
Level: Clr 3, Drd 3, Earth 3, Sor/Wiz 5
Components: V, S, M/DF
Casting Time: 1 standard action
Range: Touch
Target: Stone or stone object touched, up to 10 cu. ft. + 1 cu. ft./level
Duration: Instantaneous
Saving Throw: None
Spell Resistance: No

Under 3.0 Stone Shape wouldn't have worked because A Stone Golem is immune to everything except specific things.

In 3.5 whats to stop someone from casting this 3rd lvl spell and forever melding someones legs together?

Its seems that SR should apply for Stone Shape. Any other ideas?

A Stone Golem isn't a legal target of Stone Shape since it's not a object but a construct.
