D&D 5E Candle of Invocation

Questions:

Q. You can still attune yourself to the candle even if you don't share deity/alignment, right? (It doesn't specify any requirements on attunement)

Q. Does the candle need to be "factory fresh" for the Gate usage to function?
It only says the first thing YOU need to do with the candle is invoke Gate. It doesn't say outright you must be the candle's first user.

I'm asking because I want to know if I can give the evil bad guys the candle - with an evil alignment - without a) ruining the Gate thing for the heroes but still b) not give them 2400 free level 1 spells.

I want the bad guys to be able to light the candle and use the main benefit. I want the heroes to stop the bad guys from gating in Tiamat or whatever, and then entertain their dreams about using Gate themselves on the slightly-used evil candle afterwards. RAW or not RAW?

It says "Alternatively, when you light the Candle for the first time, you can cast the gate spell with it. Doing so destroys the Candle." I would interpret that to mean "when the candle is lit for the first time."

But obviously, you run it as works best in your scenario.

Yeah, I figured as much.

Otherwise you could burn three out of four hours, then give the candle to your buddy, and have *him* open the Gate for you...

A shame. Really limits the storytelling potential.

Oh well, so I'll scrap the idea to fight the bad guys boosted by the candle, and just focus on them deciding what to do about the Gate. ☺
