I’ve read too many published adventures over the years, so my notes are pretty much full-blown write-ups. This was my write-up for my Cyre 1313 Halloween adventure, without the maps (made in dungeon fog),logic puzzle key or handouts.

What a horrible gut-punch for the publishers. If Diamond is legally able to get away with this, I hope the publisher's lawyers would be able to force Diamond to offer the publishers first-buy rights (at pennies on the dollar) to get their stock back to attempt to resell through other avenues...
Limit your players to pulling from no more than 2 books for their abilities. Not so much for the player’s sake, but for the DMs.The more sources the DM has to track or prep for, the less is spent on handling the adventure and actin at hand.
Completely personal opinion: 3E is a severe headache...
Tell that to the dragons of Council of Wyrms. How do they get those items on? They have Demi-human (or kobolds, goblins or the like) associates who act as servants, just as any rich individual might.
I was unhappy the first time around when half-orcs were removed. Taking them (and half-elves as well) out again feels like 1989 all over again, with a different group behind the "push".
As much as I love D&D, there have been times I had to step away for one reason or another. So far, I feel I've been lucky enough I come back around to some form of RPG, if not directly D&D.

Vaguely sounds like Incarnum magic, might be worth digging through that 3E book if you can get your hands on it. Might be better fitting as a Pact granting a limited form of Alter Self (Pact of the Altered? Pact of the Aspect?) that is interlinked with Invocations, rather than revising the...
Look through many RPG products I own with the like of "page XX" references in them*, I understand why they don't - though it would be really nice if they did.
* And my own troubles getting HomeBrewery & Word to properly paginate references
